LBA Introduces New Aviation Security Training Regulation: What Will Change in the Future (Update)

The German Federal Aviation Office (LBA) has presented changes to the Aviation Security Training Regulation (LuftSiSchulV).

The information event scheduled for May 3, 2023, at the Braunschweig location was primarily attended by training providers. We were on-site and have summarized the significant changes for you, which can be described as far-reaching and, as the German Federal Aviation Office also announced, will lead to a new training system. It is intended to replace the current modular system for aviation security training.

Unified, Clearer, Stricter – The Goal of the New Aviation Security Training Regulation

The draft of the Aviation Security Training Regulation presented by the German Federal Aviation Office aims to meet the demand for EU-wide basic standards for aviation security, overall increase the level of security, and standardize the national implementation of EU requirements. During its presentation, the LBA highlighted the essential key points and changes in the 89-page draft compared to the current Aviation Security Training Regulation. It was emphasized, for example, that the scope of the new regulation is intended to be significantly expanded in certain areas, particularly concerning cyber threats and the use of dogs.

According to the draft of the new Aviation Security Training Regulation, terminologies will also change. For instance in German, "Kontrollpersonen" will be renamed to "Luftsicherheitskontrollpersonal" (likely abbreviated as LSKP). In the presented draft of the Aviation Security Training Regulation, nine out of the 36 paragraphs are dedicated solely to them. However, not only terms are changed. The German Federal Aviation Office aims to provide more clarity, such as regarding the criteria for the mental and physical suitability of aviation security control personnel. According to the LBA, a separate appendix is intended to legally sharpen these training requirements.

Changes to the Regulation Affect Control Personnel and Instructors Most Significantly

Overall, it can be said that the group of control personnel and instructors in the field of aviation security are most affected by the changes in the Aviation Security Training Regulation.

For instructors, the new regulation is noticeable especially in terms of proof management and their own training and further education. For example, in the future, teaching demonstrations will also have to be carried out during recertification, and in the draft of the Aviation Security Training Regulation, much more space is given to further education certificates in terms of scope and documentation. Finally, it is also the instructors and training providers who are affected by the sometimes significantly extended training times.

Much More Training Time with Fewer Duplications and Optional Reliability Check as a Requirement

The presented draft of the new Aviation Security Training Regulation provides for more training time for many, especially in-person trainings. A new module system – which according to the German Federal Aviation Office will then be called a training system – is intended to reduce learning time. This will be done wherever it is necessary to complete multiple aviation security trainings. According to the The German Federal Aviation Office, despite the modular structure, there were still duplications in content. These should no longer occur in the future, as the trainings can be broken down into even smaller units. And as the German Federal Aviation Office clarified, there will no longer be the usual retraining for aviation security, for example, from Chapter 11.2.6 to Chapter 11.2.3.8 of the Implementation Regulation (EU) 2015/1998. There has been no specific statement regarding when the new training system will be implemented.

There is also relief regarding the issue of reliability checks (ZÜP). In the future, it will only be a training requirement when non-publicly accessible information is part of aviation security training. Since the content of training according to Chapter 11.2.6 and 11.2.7 of the Implementation Regulation (EU) 2015/1998 usually only contains publicly accessible information, the reliability check as a training requirement will mostly be eliminated in these cases.

Aviation Security Training Regulation: What's Next and When Will the Changes Take Effect?

The draft of the new Aviation Security Training Regulation consists of nine sections, 36 paragraphs, and seven additional annexes, and is currently in the legislative process in the Federal Council as document 194/23. The new Aviation Security Training Regulation will replace and supersede the predecessor regulation of 11 April 2008 when it takes effect. The current draft mentions transitional periods at certain points in the text. However, there are only two passages that specifically name 1 January 2025 as the expiration of the transitional period. Still, the Federal Aviation Office said in Braunschweig that it would be exercising its judgment in this regard.

With the day the new Aviation Security Training Regulation comes into effect, the previous Regulation from April 11, 2008, will be repealed. The draft mentions transitional periods in some places. However, specific mention is only made in two places where January 1, 2025 is stated. However, the German Federal Aviation Office stated in Braunschweig that they intend to proceed with discretion in this regard.
